- Sweepstakes Description: The Juno "Take A Holiday From The Holidays" Sweepstakes ("Sweepstakes") begins on November 8, 2004 at 12:01 a.m. PT and ends on November 29, 2004 at 11:59 p.m. PT ("Sweepstakes Period"). For purposes of this Sweepstakes, all times refer to Pacific Time ("PT").
- How to Enter: Juno Free and Platinum members who sign up for Juno SpeedBand during the Sweepstakes Period, and are in good standing as of 11:59 p.m. PT on November 29, 2004, are automatically entered into the Sweepstakes ("Internet Entry") and will receive one (1) Internet Entry into the Sweepstakes. Juno SpeedBand members who have an active Juno SpeedBand account and are in good standing as of 11:59 p.m. PT on November 29, 2004, will automatically be entered into the Sweepstakes ("Internet Entry") without signing up for a new account and will receive one (1) Internet Entry into the Sweepstakes. Juno members who are not Juno SpeedBand members as of November 8, 2004, will receive one (1) Internet Entry into the Sweepstakes by signing up for a Juno SpeedBand account during the Sweepstakes Period. If you are not a Juno SpeedBand member, you can become a member by accessing the Juno Web Site at (http://www.juno.com) and following the online instructions to become a Juno SpeedBand member. There is a monthly fee of up to $14.95 to be a Juno SpeedBand Member. Limit one (1) Internet Entry per qualifying Juno SpeedBand account. Accounts must be set-up no later than 11:59 p.m. PT on November 29, 2004, in order to receive an Internet Entry. To enter without logging on to, or signing up for a Juno account, legibly hand-print your first name, last name, complete mailing address (including zip code, no P.O. Boxes), telephone number (including area code), and age (collectively "Mail Entry Information") on a postcard, and mail with First Class postage affixed, to: Juno "Holiday From The Holidays" Sweepstakes, P.O. Box 7489, Burbank, CA 91510. Each Mail Entry must be mailed separately, postmarked by November 29, 2004, and received by December 6, 2004. No metered mail accepted. All Mail Entry Information must be completed in full in order for Mail Entry to be eligible. Proof of delivery or receipt of Internet or Mail Entry will not be deemed by Sponsor (defined below) as proof of entry. Any attempted form of entry other than as described herein is void. Each Juno member is responsible for the accuracy of his/her billing information and/or member profile. Sweepstakes Entities are not responsible or liable for member and/or billing profiles, Internet Entries in excess of the stated limit, Internet or Mail Entries (collectively "Entries") that are incorrect, inaccurate, destroyed, incomplete, lost, misdirected, forged, damaged, mutilated, tampered with, or Mail Entries that are mass machine printed or mechanically duplicated, illegible, postage-due, or otherwise not in compliance with these Official Rules. If, for any reason, this Sweepstakes is not capable of running as originally planned, such as problems receiving Mail Entries, tampering or infection by computer virus, any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or any combination thereof, Sponsor at its sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes and conduct the drawing from all salvageable and eligible Entries received prior to and/or after (as appropriate) the action taken by Sponsor. Any person attempting to defraud Sponsor or tamper with Sweepstakes in any way will be prosecuted to the full extent permitted by law and is not eligible for a prize.
- Eligibility: Only natural persons who are legal residents in the 48 contiguous states of the U.S. (and D.C.), who are physically located and residing therein and who, (as of the time of entry) are 13 years of age or older are eligible to enter the Sweepstakes. Before entering Sweepstakes, each minor must obtain consent from his/her parent/legal guardian. Residents of Alaska, Hawaii, and Puerto Rico are not eligible to enter the Sweepstakes. Employees of United Online, Inc. ("Sponsor"), NetZero, Inc., Juno Online Services, Skycastle Entertainment, Inc., Sullivan Compliance Company ("Sweepstakes Administrator"), Sony Pictures Digital Inc., Sony Pictures Entertainment Inc., Hilltop New Media, Inc., Orbitz LLC, Carnival Cruise Lines, those involved in the development, production (including prize suppliers), implementation and distribution of this Sweepstakes, their advertising and promotion agencies, parent companies, agents, directors, officers, subsidiaries, service providers, affiliates, prize providers/manufacturers, any other persons or entities directly or indirectly associated with this Sweepstakes (collectively "Sweepstakes Entities"), members of their immediate families (spouses, children, parents, and siblings) and/or persons living in the same households as such persons (whether related or not) are ineligible to enter the Sweepstakes. Void in Alaska, Hawaii, Puerto Rico and where prohibited.
- Drawing and Notification: Potential winners will be randomly selected from all eligible Entries received, in a drawing held on or about December 15, 2004 by Sweepstakes Administrator, an independent judging organization. Potential winners will be notified by phone, mail, and/or email using the information provided on his/her Juno billing account information and/or member profile (as applicable) or on his/her Mail Entry, within approximately two (2) weeks of the drawing date. If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, or if his/her prize notification is returned as undeliverable, that potential winner will be disqualified and an alternate potential winner may be selected at Sponsor's sole discretion.
- Prizes/Odds of Winning: One (1) Grand Prize: One (1) Caribbean cruise aboard Carnival Cruise Line for Grand Prize winner and three (3) guests. Cruise is a 7-day, Western Caribbean cruise aboard Carnival Victory Ship, with an Ocean View Cabin. Departure is from Miami, FL Grand Prize includes standard cabin accommodations for Grand Prize winner and three guests (one (1) Cabin with two (2) upper and two (2) lower beds); economy class roundtrip air transportation for Grand Prize winner and three (3) guests from the nearest major airport to the Grand Prize winner's home (as determined by Sponsor at its sole discretion) to Miami, FL, provided by Orbitz; and one (1) CHRISTMAS WITH THE KRANKS stocking stuffer for Grand Prize winner only, consisting of a cap, t-shirt and CD soundtrack (Approximate Retail Value (ARV) of Grand Prize: $5,619.88). Actual value will depend on point of departure and any airfare fluctuations. Air transportation provided only if Grand Prize winner does not reside within 100 miles of Miami, Florida. Grand Prize winner must take travel by March 31, 2005 or Grand Prize will be forfeited. Quad cabins are limited on board all ships. In the event that a quad cabin is unavailable Grand Prize winner and guests will receive reasonable accommodations. Grand Prize winner and his/her guests must take air travel on same itinerary. Grand Prize trip is subject to air travel and cruise availability, holiday and blackout dates, and other restrictions will apply. Twenty-One day advance booking required. Travel must be completed by December 31, 2005. If travel is not completed by December 31, 2005, Grand Prize will be deemed forfeited. Sponsor will not replace any lost or stolen tickets, travel vouchers or certificates. Once booked, no change, extension, or substitution of trip dates is permitted, except by Sponsor at its sole discretion. Booking agents assisting with travel arrangements act only as agents for the Grand Prize winner in all matters pertaining to travel. Booking agents assume no responsibility nor liability in connection with the service of any train, vessel, carriage, aircraft, motor or other conveyances which may be used, either wholly or in part, in the performance of its duty to the Grand Prize winner and his/her guests; neither will it be responsible for any act, error, omission, or any injury loss, accident, delay or irregularity which may be occasioned by reason of any defect in any vehicle or through the neglect or default of any company or person engaged in convey of the Grand Prize winner and his/her guests. All other restrictions and limitation of liability referred to within the Carnival Cruise Lines' brochure apply. If Grand Prize winner is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless deemed to be one of the allotted guests. If a guest is a resident of a jurisdiction that deems him/her to be a minor, he/she must be accompanied by his/her parent/legal guardian, and such person must pay his/her own expenses unless he or she is the Grand Prize winner or one of the allotted travel guests. Grand Prize winner and guests are responsible for obtaining all necessary and required travel documents, upon embarkation and throughout the cruise. Grand Prize winner and/or any guest traveling without proper documentation will not be allowed to board the vessel and no refund of the cruise fare will be issued. All meals, gratuities, ground transportation, port charges and taxes, shore excursions, insurance, incidentals, departure, airport taxes and any other expenses not specified herein are the sole responsibility of the Grand Prize winner and his or her guests. Five (5) First Prizes: One (1) CHRISTMAS WITH THE KRANKS stocking stuffer consisting of a cap, t-shirt and CD soundtrack (ARV of each First Prize: $34). ARV of all prizes is $5,789.88. Odds of winning a prize depends on the number of eligible Entries received. Prize(s) are nontransferable and no substitutions allowed except by the Sponsor who reserves the right to award a prize of equal value if advertised prize is unavailable. Prize is not redeemable for cash. Winners are solely responsible for all costs, incidentals, expenses not specifically mentioned as being included. All federal, state, local or other taxes are sole responsibility of the winners. Any depictions of prizes are for illustrative purposes only. Limit one (1) prize per person/family/household.
- General Sweepstakes Conditions and Disclaimers: Sweepstakes is subject to these Official Rules and all applicable federal, state, and local laws (collectively "Rules and Laws"). By participating, entrants agree to be bound by these Official Rules and the decisions of the Sweepstakes Administrator/Sponsor, which are final and binding in all respects. If a minor is selected as a potential prize winner, the prize will be awarded in the name of minor's parent or legal guardian. Potential Grand Prize winner (his/her parent/legal guardian if he/she is a resident of a jurisdiction that deems him/her to be a minor) will be required to execute an Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release, and any other documentation that Sponsor may require (collectively "Affidavit/Release") within five (5) days of receipt of Affidavit/Release or potential Grand Prize winner will be forfeited and an alternate potential Grand Prize winner may be selected at Sponsor's sole discretion. Travel guests (their parent/legal guardians if they are residents of a jurisdiction that deems them to be minors) will be required to sign, execute, have notarized, and return a Liability Release, a Publicity Release and any other documentation that Sponsor requires within five (5) days after receipt by potential Grand Prize winner. By returning the completed Affidavit/Release, winner attests to the authenticity of his/her winning Entry. Once submitted, Entries become the sole property of Sponsor and will not be returned. Except where prohibited by law and Sponsor's Privacy Policy located at Web Site, entry into Sweepstakes and/or acceptance of prize constitutes winner's permission for the Sweepstakes Entities to: (1) use entrant's name, photograph, likeness, biographical information, statements, and address (city and state) for advertising/publicity purposes worldwide and in all forms of media (including posting on Web Site), in perpetuity, without further compensation in connection with said Sweepstakes or the prize awarded and (2) modify, edit, adapt, electronically alter, use, assign and/or dispose of Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. Information relating to minors will only be used for reporting purposes required by law; no information relating to minors will be given to third parties or used for any other purpose, except as stated herein. In case of a dispute over the identity of a potential winner that was selected from Internet Entries, Sponsor reserves the right, in its sole discretion, to deem the winner to be the owner of the member profile corresponding to the winning Internet Entry. By entering Sweepstakes, entrants agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of the Sponsor and Sweepstakes Administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Mail Entry information; acceptance/possession, use/misuse, and/or defects of the prizes awarded herein; cancellations, delays or any changes by the air carrier(s), lodging facilities, or other company or any other persons providing any of components of the prize for the Grand Prize winner and his/her guests due to reasons beyond Sponsor and/or Sweepstakes Entities control, any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, internet service provider; interruption or inability to access Sweepstakes, or Web Site, or online service via the internet due to hardware or software compatibility problems; any damage to entrants (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; any lost/delayed data transmissions, omissions, interruptions, defects and/or any other errors or malfunctions even if caused by the negligence of one of the Sweepstakes Entities. Entrants further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes, to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize.
