- Sweepstakes Description: The NetZero HiSpeed High Score Sweepstakes ("Sweepstakes") begins on March 21, 2006, at 12:01 a.m. PT and ends on April 18, 2006, at 11:59 p.m. PT ("Sweepstakes Period"). For purposes of this Sweepstakes, all times refer to Pacific Time ("PT"), and Sponsor's Sweepstakes computer is the official time keeping device for this Sweepstakes.
- How to Enter: To enter online, current NetZero Free and Platinum members that are in good standing, as defined by Sponsor, as of 11:59 p.m. PT on March 21, 2006, and who upgrade to a NetZero HiSpeed account within the Sweepstakes Period will receive one (1) entry into the Sweepstakes ("Internet Entry"). Individuals who are not NetZero HiSpeed members as of March 21, 2006, will receive one (1) Internet Entry into the Sweepstakes upon activation of a NetZero HiSpeed account during the Sweepstakes Period. If you are not a current NetZero HiSpeed member, you can become a member by accessing the NetZero Web site at www.netzero.com/benchwarmers and following the online instructions to become a HiSpeed member. There is a standard monthly fee of $14.95 to be a NetZero HiSpeed member. Limit one (1) Internet Entry per qualifying NetZero HiSpeed account. Accounts must be upgraded or set-up no later than 11:59 p.m. PT on April 18, 2006. To enter without logging on or signing up for a NetZero HiSpeed account, legibly hand-print your complete name, address (including zip code; no P.O. Boxes), telephone number (including area code), e-mail address (optional) and date of birth (collectively "Mail Entry") on a postcard, and mail with proper postage affixed, to: NetZero HiSpeed High Score Sweepstakes P.O. Box 6249 Burbank, CA 91510. Each Mail Entry must be mailed separately, postmarked by April 19, 2006, and received by April 25, 2006. No metered mail accepted. No copies, facsimiles or reproductions of Mail Entries will be accepted. Except as otherwise stated herein as optional, all required Internet Entry information/Mail Entry information (collectively Entries) must be completed in full. Proof of delivery or receipt of any kind of Entry will not be deemed by Sponsor (as defined below) as proof of entry. Internet Entries of any kind by the same person in excess of the limits stated herein will be disqualified. Any attempted form of entry other than as described herein is void. Sweepstakes Entities (as defined below) are not responsible or liable for member and/or billing profiles and entries that are incorrect, inaccurate, destroyed, incomplete, lost, misdirected, forged, damaged, mutilated, tampered with, or Mail Entries that are mass machine printed or mechanically duplicated, illegible, postage-due, or otherwise not in compliance with these Official Rules. If, for any reason, this Sweepstakes is not capable of running as originally planned, such as problems receiving Mail Entries, tampering or infection by computer virus, any technical malfunctions of the telephone network, computer online system, computer dating mechanism, computer equipment, software, or any combination thereof, Sponsor at its sole discretion, reserves the right to cancel, suspend or modify the Sweepstakes and conduct the drawing from all salvageable and eligible Entries received prior to and/or after (as appropriate) the action taken by Sponsor. Any person attempting to defraud Sponsor or tamper with Sweepstakes in any way will be prosecuted to the full extent permitted by law and is not eligible for a prize. Once submitted, Entries will not be returned and become the sole property of Sponsor.
- Eligibility: Only natural persons who are legal residents in the 48 contiguous states of the U.S., Hawaii, and D.C., (Alaska excluded) who are physically located and residing therein and who (as of the time of entry) are 18 years of age or older are eligible to enter the Sweepstakes. If entrant is a resident of a jurisdiction that deems him/her to be a minor, he/she must obtain parental/legal guardian consent prior to entering or submitting any personally identifiable information. Residents of Alaska and Puerto Rico are not eligible to enter the Sweepstakes. Employees of United Online, Inc. ("Sponsor"), Hilltop New Media, Inc., Sony Pictures Digital, Inc., Sony Entertainment Inc., Skycastle Entertainment, Inc., Sullivan Compliance Company ("Sweepstakes Administrator") or those involved in the development, production (including prize suppliers), implementation and distribution of this Sweepstakes, their advertising and promotion agencies, parent companies, agents, directors, officers, subsidiaries, service providers, affiliates, prize providers/manufacturers, any other persons or entities directly or indirectly associated with this Sweepstakes (collectively "Sweepstakes Entities"), members of their immediate families (spouses, children, parents, and siblings) and/or persons living in the same households as such persons (whether related or not) are ineligible to enter the Sweepstakes. Void in Alaska, Puerto Rico and where prohibited.
- Drawing and Notification: Potential winners will be randomly selected from all eligible Entries, in a drawing held on or about May 2, 2006 by Sweepstakes Administrator, an independent judging organization. Potential winners (his/her parent/legal guardian, if a potential winner is a resident of a jurisdiction that deems him/her a minor) will be notified by phone, mail, and/or email using the information provided on his/her NetZero billing account information and/or member profile (as applicable) or on his/her Mail Entry, within approximately five (5) days of the drawing date. If a potential winner cannot be reached after a reasonable effort has been exerted, if he/she is found to be ineligible, if he/she cannot or does not comply with these Official Rules, and/or if his/her prize notification is returned as undeliverable, that potential winner will be disqualified and an alternate potential winner may be selected at Sponsor's sole discretion. If notified by email, potential winner will be required to respond to the prize notification email within three (3) business days or his/her entry will be disqualified, his/her prize forfeited and an alternate potential winner may be selected. NetZero Free, Platinum, and HiSpeed members are solely responsible for updating billing/contact information for their account.
- Prizes/Odds of Winning: One (1) Grand Prize: Grand Prize Winner will receive one (1) 60" Grand WEGA 3LVD Rear Projection HDTV (Model KDF-E60A20) (Approximate Retail Value ("ARV"): $3,200.00); one (1) Benchwarmers Hat (ARV: $15.00); one (1) Benchwarmers Water Bottle (ARV: $10.00); and one (1) Benchwarmers Seat Cushion (ARV: $10.00). Total ARV of Grand Prize: $3,235.00. Ten (10) First Prizes: Each First Prize Winner will receive one (1) Benchwarmers Fan Pack consisting of: one (1) Benchwarmers Hat (ARV: $15.00); one (1) Benchwarmers Water Bottle (ARV: $10.00); and one (1) Benchwarmers Seat Cushion (ARV: $10.00). Total ARV of each First Prize: $35.00 (U.S.). Grand Total ARV of all prizes: $3,5850.00. Prize(s) are nontransferable, no cash equivalent and no substitutions allowed except by the Sponsor who reserves the right to award a prize of equal value if advertised prize is unavailable. Odds of winning a prize depends on the number of eligible Entries received. Limit one (1) prize per person/family/household. Winners are solely responsible for all costs, incidentals, any requested product upgrades/options, installation and any other expenses not specifically mentioned as being included. In the event that a prize component (including but not limited to a discontinued model) is not available for any reason, then remaining elements of prize shall constitute full satisfaction of Sponsor's prize obligation to winner and no additional compensation will be awarded. Prizes will be shipped to street addresses in 48 contiguous states of the U.S., Hawaii, and D.C., (Alaska excluded) only. Any depictions of prizes are for illustrative purposes only. All federal, state, or other taxes are sole responsibility of the winners. Grand Prize winner will receive an IRS form 1099 from the Sponsor for the total ARV of prize (stated herein) that he/she won in the calendar year that he/she won.
- General Conditions: Sweepstakes is subject to these Official Rules and all applicable federal, state, and local laws (collectively "Rules and Laws"). Potential Grand Prize winner (his/her parent/legal guardian, if potential winner is a resident of a jurisdiction that deems him/her a minor) may be required to sign, execute, have notarized, and return an Affidavit of Eligibility, a Liability Release, (where legal) a Publicity Release, and any other documentation that Sponsor may require (collectively Affidavit/Release) within five (5) days of receipt of Affidavit/Release or potential Grand Prize winner may be disqualified and an alternate potential Grand Prize winner may be selected at Sponsor's sole discretion. If a winner is a resident of a jurisdiction that deems him/her to be a minor, prize will be awarded in the name of his/her parent/legal guardian. By returning the completed Affidavit/Release, Grand Prize winner attests to the authenticity of his/her winning entry. Any personal information supplied by entrants to Sponsor or its affiliates will be subject to Sponsor's Privacy Policy (and terms of service posted at the Web Site). Thus, except where prohibited by law or Sponsor's Privacy Policy: (1) entry and/or winner's (winner's parent/legal guardian, if winner is minor) acceptance of prize constitutes permission for the Sweepstakes Entities to use winner's name, address (city and state), photo, likeness, biographical information, statement and voice for advertising/publicity purposes worldwide and in all forms of media (including posting on Web Site), in perpetuity, without further notice to or compensation in connection with said Sweepstakes or the prize awarded and (2) Sponsor has the right to modify, edit, adapt, electronically alter, use, assign and/or dispose of such Entries however it sees fit and for any purpose without any notice or compensation to entrant or any third parties. Additionally, by opting-in to specific offers from any of the Sweepstakes Entities, entrant's Entry information will be subject to their respective privacy policies and terms of service and entrant agrees to receive additional email communication from those companies. By submitting entry information, entrant confirms the accuracy and veracity of the statements and information contained therein. Any person attempting to defraud or tamper with Sweepstakes will be prosecuted and is not eligible for prizes. In case of a dispute over the identity of a potential winner that was selected from Internet Entries, Sponsor reserves the right, in its sole discretion, to deem the winner to be the owner of the member profile corresponding to the winning Internet Entry.
- Disclaimers: By entering Sweepstakes, entrants agree and acknowledge to be bound by the Rules and Laws, as well as the decisions of the Sponsor and Sweepstakes Administrator which are final and binding in all respects; to waive any rights to claim ambiguity with the Rules and Laws, and that Sweepstakes Entities shall have no responsibility or liability (including, but not limited to, liability for any property loss, damage, personal injury or death) in connection with: participation in this Sweepstakes; human error; incorrect or inaccurate transcription of Mail Entry information; acceptance/possession, use/misuse, and/or defects of the prizes awarded herein; any technical malfunctions of the internet service provider; interruption or inability to access sweepstakes, or Web Site, or online service via the internet due to hardware or software compatibility problems; any damage to entrants (or any third person's) computer and/or its contents related to or resulting from any part of this Sweepstakes; and/or any lost/delayed data transmissions, omissions, interruptions, defects or any other errors or malfunctions even if caused by the negligence of one of the Sweepstakes Entities. Entrants further agree to indemnify and hold harmless the Sweepstakes Entities from any and all liability resulting or arising from the Sweepstakes, to release all rights to bring any claim, action or proceeding against the Sweepstakes Entities, and hereby acknowledge that said Sweepstakes Entities have neither made nor are in any manner responsible or liable for any warranty, representation or guarantee, express or implied, in fact or in law, relative to any prize. Sony Electronics Inc. has not offered, participated in or sponsored this Sweepstakes in any way.
- Rules/Winners List: To receive the Names of Winner(s) or an additional copy of these Official Rules, send a self-addressed stamped envelope to: NetZero HiSpeed High Score Sweepstakes, Rules/Winners (specify which), P.O. Box 11415, Burbank, CA 91510. All requests must be received by June 16, 2006. Official Rules may also be accessible from the Web Site. Winners' names may also be posted on the Web Site.
